RECOMMENDATION:

Staff recommends the City Council adopt an Ordinance amending Section 9.07.035, Construction, of Chapter 9.07, Noise Regulations, of the Culver City Municipal Code, to allow the limited expansion of construction hours under certain circumstances, as authorized by permit (Attachment 1).

BACKGROUND / DISCUSSION:

At its meeting of October 10, 2016, the City Council (by a vote of 5-0) introduced, for first reading, the proposed Ordinance amending Section 9.07.035, Construction, of Chapter 9.07, Noise Regulations, of the Culver City Municipal Code, to allow the limited expansion of construction hours under certain circumstances, as authorized by permit.

Included in the proposed Ordinance presented for adoption are minor edits to clarify outdated language relating to the operation of musical devices on a construction site (subsection B).  These edits were previously directed by the City Council but inadvertently omitted in the draft presented for introduction.  Thus, this clarifying language does not require reintroduction of the Ordinance.

The proposed Ordinance, as clarified, is presented for adoption.

FISCAL ANALYSIS:

Adoption of the Ordinance does not create a fiscal impact.
